Small Business Relief to 2029: who qualifies and how the election works
What is Small Business Relief in the UAE?
Small Business Relief (SBR) is a corporate tax concession for small businesses. If you qualify and elect it, you are treated as having no taxable income for that tax period. The 9% rate simply does not bite.
It sits alongside the 0% band on the first AED 375,000 of taxable income, which every taxable person gets anyway. SBR matters when your profit is above that band but your revenue is still modest. The rules come from the UAE corporate tax framework published by the Federal Tax Authority and the Ministry of Finance. Ministerial Decision No. 131 of 2026 extended the relief to tax periods ending on or before 31 December 2029; it was previously due to end with periods ending on or before 31 December 2026. That is the position as at October 2026.
Who qualifies for Small Business Relief?
You need to meet all of these:
- You are a resident taxable person (a UAE company, or an individual running a business that is within the corporate tax net).
- Your revenue is AED 3 million or less in the relevant tax period and in all earlier tax periods.
- You are not a Qualifying Free Zone Person.
- You are not a member of a multinational group with consolidated group revenue of more than AED 3.15 billion (FTA, as at October 2026).
The test is revenue, not profit. A consultancy turning over AED 2.8 million with healthy margins qualifies. A trading business turning over AED 3.4 million at thin margins does not.
How does the Small Business Relief election work?
You do not apply in advance and nobody grants it. You register for corporate tax, then tick the election when you file the return for the period. The return is filed through the FTA’s EmaraTax portal.
Because it is made period by period, you can choose differently each year while you remain eligible. That flexibility is useful, and it is also where mistakes creep in, because nobody prompts you to think about it.
What do you give up by electing?
Relief is not free. The main trade-offs:
| Point | Elect SBR | Do not elect |
|---|---|---|
| Tax on taxable income | Treated as nil | 0% to AED 375,000, then 9% |
| Tax losses | Not carried forward from relief periods | Can be carried forward under the usual rules |
| Tax groups and loss transfers | Not available | Available if conditions are met |
| Registration and filing | Still required | Required |
| Transfer pricing documentation | Exempt, though arm’s length pricing still applies | Applies where related-party thresholds are met |
The loss point catches people. A new company expecting early losses and profit later may be better off not electing in the loss years, so the losses are preserved for the profitable ones.
Should a freezone company elect SBR or aim for QFZP status?
This is the decision we see most often. A Qualifying Free Zone Person pays 0% on qualifying income but 9% on the rest, and needs genuine substance, qualifying activities and clean records. Free zones such as DMCC, IFZA, Meydan, RAKEZ and Sharjah’s SHAMS all host companies in this position, and the rules do not change by emirate.
For a small freezone company with revenue well under AED 3 million, SBR is often the simpler route. It removes the tax on all income, including non-qualifying income that would otherwise be taxed at 9%. QFZP status is built for larger operations that can meet the conditions every year. It also matters that a company which fails the QFZP conditions pays standard rates for that period and the next four, so do not drift into the decision.
What are the common mistakes?
- Assuming it is automatic. It is not. No election, no relief.
- Ignoring earlier periods. Revenue above AED 3 million in any prior period can disqualify you in later ones.
- Treating relief as exemption from filing. The return is still due, and penalties for missed registration and filing apply regardless.
- Splitting a business to stay under the line. Anti-abuse rules exist and the FTA looks at substance, not paperwork.
- Forgetting the loss trade-off in a start-up year.
Individuals who run a business in their own name have additional questions about when the corporate tax net applies at all. Our guide on whether the UAE really has 0% personal income tax covers that boundary.
Does the answer depend on your situation?
Yes. Your activity, whether you sit in a freezone or on the mainland, your group structure and your expected profit curve all change the right call. The general rule is clear: if you are a small resident business outside QFZP status, SBR is usually worth electing once you are profitable, and worth pausing on if you are carrying losses you will need.

Questions people ask
Is Small Business Relief automatic in the UAE?
No. It is an election you make in the corporate tax return for each tax period. If you do not elect, you are taxed in the normal way at 9% on taxable income above AED 375,000. You still have to register and file either way.
What is the Small Business Relief revenue threshold?
AED 3 million of revenue, tested on revenue rather than profit. The limit applies to the current tax period and every earlier one, so a single year above it can close the door. Check the Ministry of Finance decision for exactly how periods are counted in your case.
Can a freezone company claim Small Business Relief?
Only if it is not a Qualifying Free Zone Person for that period. A freezone company that fails the QFZP conditions, or a freezone company that is simply taxed at 9%, can elect the relief if it meets the revenue test. A QFZP cannot.
Do I still need to register for corporate tax if I elect Small Business Relief?
Yes. Registration, return filing and record keeping all remain. The relief removes the tax charge, not the compliance. Late registration penalties can apply even where no tax is due.
Does Small Business Relief last until 2029?
The relief has been extended so that it covers tax periods ending on or before 31 December 2029, having originally been set to end in 2026. Confirm the current Ministerial Decision on the Ministry of Finance site before relying on a specific period.
